OBTAINING INFORMATION VIA A DSAR REQUEST
One way to find out everything the Mortgage Co/Bank have on you is to send them a DSAR - that is a Subject Access Request - it is good to do this and is totally independent of the process we have below, so no need to await the results of that before launching your Mortgage Process.

The company is legally obliged to furnish you with all information they hold on you, including all monies paid, full details of mortgage and signed Deed etc, however since they do not have the proper signed deed - and also proper deed of assignment if it has been taken over by not the original lender, not just notice - they have already fallen into fraud. A person is in breach of this section if he— (a) dishonestly fails to disclose to another person information which he is under a legal duty to disclose, and (b) intends, by failing to disclose the information— (i) to make a gain for himself or another, or (ii) to cause loss to another or to expose another to a risk of loss.
In the event that this notice is dishonoured and it is established by the facts of the matter that your company has committed fraud, please take notice that [NAME OF MORTGAGOR] will begin any and all administrative and/or judicial proceedings deemed necessary, in order to recover three times the value of your company’s invalid claim in damages, plus the principal allegedly owed.
